It appears that the Sections you quoted allow you to appeal any decision of the P&Z Commission, within the allotted timeframe, and following the procedures and payment of fees as set by resolution by the Board of County Commissioners. The filing fee for an appeal, as set by resolution #2007-10, is $400.00. Along with your payment, simply enclose a letter stating the basis of your appeal, mailed to the Planning and Zoning Administrator.

 

I would like to point out that in your previous e-mail you indicated you wished to appeal the CUP hearing conduct April 5th. Please be advised the Public Hearing conducted April 5, 2007, was not a CUP (Conditional Use Permit) but rather a Final Planned Unit Development (PUD) Permit and Final Subdivision Plat approval request. You may recall in the opening remarks by the Planning and Zoning Chairman at the hearing, he indicated the purpose of the hearing was technical review only of the PUD and Subdivision Plat. The CUP portion and hearing of Southfork Landing that you may be referring to was conducted in the Spring on 2006. That P&Z decision was to approve the CUP to allow the Planned Unit Development. That CUP decision was not appealed and the time for an appeal has expired. Should you choose to file an appeal now of the April 5th hearing, you would be appealing the P&Z decision of Final PUD approval and approval of Subdivision Plat Phase of Southfork Landing.
